These Terms of Service ("Terms") govern your access to and use of the ASOTool services, including our A/B Testing AI for App Store Optimization platform (the "Service"), and any related tools, applications, data, and other services provided by us.

Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the Service.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

• Maintain the security of your account credentials
• Accept all risks of unauthorized access to your account and the information you provide to us

Use of Service

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Use the Service for any purpose that is unlawful or fraudulent
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Use the Service in any manner that could disable, overburden, damage, or impair the Service
• Use any robot, spider, or other automatic device, process, or means to access the Service
• Use any manual process to obtain information about other users for unauthorized purposes
• Use any technology to circumvent or remove any functionality or features of the Service

Provision of Services

Subject to these Terms, we will provide the Service in a manner generally consistent with professional services and in a professional and workmanlike manner. We will use commercially reasonable efforts to ensure the Service is available to you on a continuous basis, subject to scheduled maintenance and emergency repairs.

App Data and Intellectual Property

You retain all rights to your app data, app metadata, and any other content you upload to our platform. However:

• You grant us a limited license to use your content solely to provide the Service to you
• You are solely responsible for the accuracy, quality, and legality of your app data
• You grant us permission to make your app data available to third-party platforms (e.g., app stores) as required to provide the Service
• You acknowledge that we may collect and use technical data about your usage to improve our Service

Proprietary Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Subscription and Billing

Your access to certain features of the Service may require a paid subscription. You agree to:

• Provide current, complete, and accurate billing information
• Pay the fees for your subscription in accordance with the pricing and payment terms
• Authorize us to charge you for such services
• Pay all applicable taxes
• Not cancel your subscription just before a scheduled payment in an attempt to avoid charges

We reserve the right to change our subscription fees and billing practices at any time with notice to you.

Cancellation

You may cancel your subscription at any time. You will be responsible for all charges through the end of your current billing period. Upon cancellation, your access to the Service will cease at the end of your current billing period.

Limitation of Liability

IN NO EVENT WILL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

Entire Agreement

These Terms constitute the entire agreement between you and ASOTool regarding the use of our Service, superseding any prior agreements between you and us relating to your use of the Service.
